Bondi Surf Girls Lombok Retreat - Terms & Conditions + Liability Waiver

1. General Overview

1.1. These Terms & Conditions (“Terms”) govern your participation in the Bondi Surf Girls Lombok Retreat (“Retreat”) operated by Bondi Surf Girls Pty Ltd (“BSG”, “we”, “us”).

1.2. By booking, paying for, or participating in any retreat activity, you (“Participant”, “you”) agree to be bound by these Terms and the liability waiver herein.

1.3. Activities taking place in Indonesia fall under Indonesian law. Bookings and payments made in Australia remain subject to Australian Consumer Law. Participants agree not to pursue legal action from outside Indonesia for incidents occurring during the retreat.

2. Retreat Description

2.1. The Retreat may include:

  • Surf coaching & guided surf sessions

  • Video analysis and skill development

  • Yoga, mobility, breathwork & wellness sessions

  • Snorkeling activities

  • Community events & social gatherings

  • Accommodation at Xanadu Surf & Yoga Village

  • Surf equipment use

  • Transport to surf spots and local excursions

  • Breakfast and selected meals

2.2. Schedule, surf locations, and activities may change due to tides, weather, safety, or operational needs. No refunds are provided for changes caused by conditions outside of BSG control.

3. Eligibility & Participant Declarations

3.1 Medical Fitness

Participants must confirm they do not suffer from:

  • Asthma

  • Epilepsy

  • Pregnancy

  • Heart conditions

  • High blood pressure

  • Recurrent blackouts

  • Previous injuries that may reoccur

  • Spinal or back injuries

  • Severe joint sprains

  • Serious mental health conditions that may impair safe participation

Participants must also declare they have no condition or injury that would make surfing, yoga, snorkeling, breathwork, cold exposure, or travel unsafe.

3.2 Swimming Competency

Participants must confirm they:

  • Can swim confidently in open water

  • Can maintain buoyancy without assistance

  • Are not novice swimmers

  • Can keep their head above water for extended periods

Surf retreats require strong water confidence.

4. Participant Responsibilities

Participants agree to:

  • Follow all instructions from BSG, Xanadu, surf coaches, instructors, and guides

  • Use equipment safely

  • Disclose any new injuries or conditions immediately

  • Stop participation if experiencing pain, discomfort, or fatigue

  • Respect local culture, laws, and environmental guidelines

  • Behave respectfully toward staff and other guests

Failure to follow safety instructions may result in removal from activities with no refund.

5. Travel Insurance (Mandatory)

5.1. Participants MUST hold valid travel insurance covering:

  • Surfing

  • Snorkeling

  • Outdoor activities

  • Medical treatment & hospital care

  • Evacuation

  • Trip cancellation

  • Personal belongings

5.2. Proof of insurance may be requested before or at arrival.

6. Payments, Deposits & Cancellations

6.1. A $500 AUD refundable deposit is required to reserve your spot. The outstanding balance must be paid within 7 days of paying the deposit.

We’re a small business, and cancellations directly impact our ability to run these retreats. Because of this, we will not be able to issue a refund once the full payment has been made. In the unlikely occurrence that the retreat must be postponed due to government regulations or unforeseen circumstances, an alternative date will be offered or a partial refund.

7. Equipment Use & Damage

7.1. Participants accept responsibility for surfboards and equipment assigned to them.

7.2. Participants agree to pay for:

  • Repair costs

  • Replacement costs

  • Damage caused by negligence

  • Damage occurring when surfing without supervision

8. Safety, Risks & Assumption of Liability

Surfing, snorkeling, yoga, travel, and outdoor activities involve inherent risks, including but not limited to:

  • Loss of board control

  • Collisions with people, reefs, rocks, or objects

  • Equipment failure

  • Falls or impact injuries

  • Strong currents, tides, rips, or waves

  • Submersion or drowning

  • Marine life injuries

  • Coral cuts, infections, algae, bacteria

  • Extreme temperatures, sun exposure, dehydration

  • Transport risks (cars, boats, scooters)

  • Unavailability or delay of medical assistance

  • Emotional discomfort during wellness practices

  • Unknown or unanticipated risks

Participants fully assume all such risks, including the risk of serious injury, paralysis, illness, or death.

9. Yoga, Mobility, Ice Baths & Wellness Activities

Participants acknowledge these activities may involve:

  • Overstretching or strain

  • Emotional discomfort

  • Improper alignment

  • Physical fatigue

  • Cold exposure risks (for ice baths)

  • Balance-related falls

Participants voluntarily assume all risks involved.

10. Transport & Snorkeling

10.1. Participants understand that transport to surf spots may include cars, vans, scooters, or local boats, which may involve risk of accident or injury.

10.2. Snorkeling involves inherent risks, including drowning, marine life encounters, reef cuts, visibility challenges, or vessel-related risks.

Participants assume all risks associated with transport and snorkeling.

11. Medical Treatment Consent

Participants:

  • Consent to receive necessary medical treatment in case of injury or emergency

  • Accept full financial responsibility for such treatment

  • Release BSG and Xanadu from liability regarding medical decisions taken in good faith

12. Personal Property

BSG and Xanadu are not responsible for loss, theft, or damage to:

  • Phones, electronics

  • Surfboards (personal or rented)

  • Bags, wallets, clothing

  • Personal items left in rooms or public areas

Participants are responsible for securing their belongings.

13. Release, Waiver & Indemnity

To the fullest extent permitted by Indonesian law, Participants:

13.1 Release & Waive Liability

Release BSG, Xanadu, instructors, employees, agents, and partners from all claims arising from retreat participation — including those caused by negligence.

13.2 Indemnify

Agree to indemnify BSG and Xanadu from all claims, damages, legal fees, losses, or expenses arising from:

  • Participant’s actions

  • Injury resulting from participation

  • Damage to property or equipment

  • Breach of these Terms

13.3 Binding Effect

This release is binding on the Participant, their heirs, executors, assigns, and legal representatives.

14. Media Consent

Unless notified in writing, participants consent to the use of photos/videos taken during the retreat for BSG’s marketing and promotional material.

15. Governing Law & Jurisdiction

15.1. Activities occurring in Indonesia are governed by Indonesian law.

15.2. Participants agree not to initiate legal proceedings outside Indonesia for incidents occurring during the retreat.

15.3. Booking and payment processes for Australian residents remain subject to Australian Consumer Law.

16. Acceptance

By booking, paying for, or attending the BSG Lombok Retreat, the Participant confirms that they have read, understood, and voluntarily agree to all Terms & Conditions and the Liability Waiver.
